Justice and Power in the Sociolegal Studies asks what interdisciplinary work in the law and society tradition tells us about the relationship of law and justice, as well as the way power operates in and through law. The fundamental concepts of justice and power provide points of departure for leading scholars to explore the various domains of socio-legal research. As they note the explicitness of the engagement with issues of power and the relative silence about -- or indirectness in taking (...) on -- questions of justice found in most law and society research, they ask how engagement with issues of power and silence about justice constituted law and society as a research field caught between a desire to have political impact and, at the same time, to maintain its scientific respectability. Eugen Bleuler introduced the concept of double bookkeeping in schizophrenia to describe the tendency for people who experience delusions to simultaneously be convinced of the delusional content and yet to act as if the delusion(s) was untrue/irrelevant or be unbothered by discrepancies. We open the question of whether there exists a double reality in individuals with addiction and whether double bookkeeping can be applied to addiction. While double bookkeeping has primarily been explored in schizophrenia, this concept may hold promise in (...) elucidating insight deficits in individuals with substance use disorders. We propose two forms of addiction double bookkeeping: 1) Partial compartmentalization: individuals demonstrate some awareness of the deleterious consequences of drug use, but continue to engage in addictive behaviors; and 2) Total compartmentalization: individuals who act as if the negative consequences of addiction do not exist, reflecting a more generalized and deeper lack of awareness into their own actions. We propose that a basic alteration in the individual’s sense of self occurs in addiction double bookkeeping as it does in schizophrenic double bookkeeping. We describe the proposed double reality in addiction from first-person and third-person perspectives, accounting for their differences. Three clinical exemplar cases are presented, and conceptual implications are explored. (shrink)

The MS. tradition of Prudentius is particularly interesting, since in the famous Codex Puteanus we have a MS. dating from the early sixth century—i.e. but little more than a hundred years after the publication of the collected poems in 405. Yet it has only been of late years that due consideration has been given to this ancient Codex, which is the actual MS. corrected by Vettius Mavortius' own hand. Mr. Winstedt has spoken of the neglect which it has suffered for (...) the most part from editors, and also of the similar lack of attention paid even by Dressel to its seventh-century companion at Milan—the Codex Ambrosianus; while, later, J. Bergman shewed himself enthusiastic in its praise . A confirmation is now available of a curious and generally discredited reading in this MS. , from that same Arma glossary of ‘saec. viii.-ix’ which bears witness to the readings of a lost Terence MS. of the δ-family, the best minuscule family, older than any extant MS., as I shewed in the April, 1925, number of this journal. At Prud. Apoth. 895 the reading of Puteanus is— Agenitus genitusque deus, pater et patre natus. (shrink)

‘Agathon and Eudaimonia in the Ethics of Aristotle’ is a response to an article on the meaning of Agathon in the Ethics of Aristotle, published by H. A. Pritchard in 1935. In this paper, Pritchard argued that Aristotle regarded Agathon to mean ‘conducive to our happiness’ and, consequently, that he maintained that every deliberate action stems, ultimately, from the desire to become happy. Austin finds fault with this view: first, Agathon in Aristotle does not have a single meaning, and (...) a fortiori not the one Pritchard suggested; secondly, if one had to summarise the meaning of ‘being agathon’ in one phrase, then ‘being desired’ cannot fulfil this function, for there are other objects of desire besides τό άγαθόν. Picks up on a previous discussion of responsibility, freedom, and excuses, in which Austin argues that, in order to discover whether someone acted freely, we must discover whether certain excuses relevant to the situation at hand are acceptable. The notion of freedom, according to this view, is intractably linked to the notion of responsibility. Chapter 12 refines the previous discussion, by illuminating the differences between the notions of purpose, intention, and deliberation in a variety of speech acts.

Austin discusses the existence, origin, and resemblance of concepts, primarily by discussing the meaning of ‘concept’ and ‘universal’. He argues that, although sometimes it may not be harmful to talk about concepts, we neither understand the meaning of ‘concept’, nor the meaning of ‘acquiring and possessing concepts’, nor a view of concept resemblance as non-sensuous acquaintance or awareness, challenging philosophers who couch their theories in such terms to illuminating them first.

On Aen. 2. 277 DServius notes ‘non sine ratione etiam hoc de crinibus dolet Aeneas, quia illis maxime Hector commendabatur, adeo ut etiam tonsura ab eo nomen acceperit, sicut Graeci poetae docent.’ Fraenkel showed that the reference in Graeci poetae is to Lycophron , the source of the comment being provided by Eustathius 1276. 29, a scholion on Il. 22. 401 f. He adds a caution against supposing that Servius’ source referred not only to Lycophron but also to other Greek (...) poets, ‘e.g. some Attic comedians’. That such allusions were in fact made in Comedy is proved by Pollux. (shrink)

Deals with the question of whether there is a use of ‘is true’ that is the primary or generic name for that which at bottom we are always saying ‘is true’. Austin discusses the views that truth is primarily a property of beliefs and of true statements. He goes on to argue that the word ‘true’ denotes the validity of an intended correspondence between a representation and what it represents, and dismantles confusions about the meaning of the words that (...) underlie such a view, such as ‘fact that’ and ‘corresponds’. The clear affinity between Quintilian's art-criticism and the comparable portions of Pliny's Natural History has often been remarked. Pliny's principal sources for his chapters on art have long been recognized as going back through Varro to the great third-century critics, Xenocrates of Sicyon and Antigonus of Carystus, the latter of whom worked over Xenocrates' treatise and incorporated new material of his own; an earlier Greek source was Duris of Samos, on whom Antigonus drew for the anecdotic element in his tradition. The careful work of many patient scholars has been successful in disentangling to a considerable extent the characteristic contributions of these and other authorities to Pliny's medley of information. On the other hand, Quintilian's incursion into the same field seems never to have been studied independently, but only incidentally to research on the Plinian sources. The purpose of this paper is to examine Quintilian's contribution afresh; my indebtedness to earlier studies, in particular to those of Robert, will be readily apparent. (shrink)

Few critics can ever have shown more light-hearted thoughtlessness towards an anxious posterity than Servius in his casual preservation of the ‘Helen-episode’, lacking in our ancient manuscripts of Virgil and primarily extant only in this precarious form. A pity that Servius spoke at all, if he could not tell us more; and to make matters worse, he ignored the lines in his commentary. Aelius Donatus says nothing of them. Tiberius Claudius Donatus passes peacefully in his interpretatio from 2. 566 to (...) 2. 589; his prosy conscientiousness nowhere else allows him to skip so much. The passage so rashly preserved forms an exasperating Tummelplatz for students of Virgil: ‘quadereviridoctiiampridem inter se certarunt semperque, ni fallor, certabunt.’ The purpose of this paper is to suggest that Servius told the truth about the lines, and was not planting a forgery on a credulous world. A reconstruction based on previously unpublished notes, of Austin’s views of the Line and Cave allegories in Plato’s Republic. In these drafts, Austin discusses the prominent issues that arise in the context of Plato’s Line allegory, e.g. the questions of division and continuity, and shows how the different stages in the Cave allegory correspond to individual sections of the Line.

Addresses Bedford’s attack on appeals to introspection in the identification of emotions, which lead him to raise the question of how to draw the line between genuine and pretended anger. Austin demonstrates, through a close examination of the speech acts of ‘pretending’ and ‘really being’, that none of the supposed conditional relations between these two notions actually holds. The essay further introduces Austin’s distinction between ‘pretending to do’ and ‘pretending to be’ and emphasises the complex and diverse forms (...) speech acts involving ‘pretending’ can take. If the Bucolics as a whole ‘ look on us with dark enigmatical eyes,’ for long no more impenetrable darkness and no more compelling enigma could be found than that of the fourth poem in the collection. But Skutsch, the authors of Virgil's Messianic Eclogue, and more recently Mr. Royds in his Virgil and Isaiah, have done much to solve its many mysteries. Their efforts, however, were mainly directed towards the problems of fact contained in the Eclogue, and so far (...) little attention seems to have been given to an equally interesting point, that of its metrical arrangement. It is plain that we must consult the Sibyll for help: if it is not plain, that is not Virgil's fault. I hope to be able to show here that Virgil himself has left in this poem certain unmistakeable signs for those who have eyes to see and ears to hear, besides his own rather casual reference to the Cumaeum carmen, and incidentally to dispose anew of the theory which reads in that expression an allusion not to the Sibyl but to Hesiod. Health disparities education is an integral and required part of medical professional training, and yet existing curricula often fail to effectively denaturalize injustice or empower learners to advocate for change. We discuss a novel collaborative intervention that weds the health humanities to the field of health equity. We draw from the health humanities an intentional focus retraining provider imaginations by centering patient narratives; from the field of health equity, we draw the linkage between stigmatized social identities and health disparities. We (...) describe a longitudinal health equity curriculum for the Hospice and Palliative Medicine fellowship in Memphis, Tennessee, to give trainees exposure to the concept of structural violence and how it affects clinical care. The curriculum was developed in partnership with humanities and social sciences faculty who staff a Health Equity academic program at a small liberal arts college in Memphis. This curriculum has been implemented for the past four years in support of 22 hospice and palliative medicine fellows. Group debriefs and a mixed methods survey have revealed widespread and lasting impact towards understanding health equity concepts, enhanced communication and treatment of patients, and empowerment to address the broader needs and policies affecting patients and the communities in which they live. Ultimately, we model an educational initiative that integrates equity across the full scope of healthcare practice and equips learners with skills for sustaining compassionate practices, focusing on equity-oriented, person-centered care across the full scope of healthcare practice. Post-market pharmaceutical surveillance or ‘pharmacovigilance’ relies on the reporting of suspected adverse drug reactions to regulatory databases. Recently, more ‘active’ methods that directly involve patients in identifying and reporting suspected adverse drug reactions have been suggested. This is different than traditional ‘passive’ methods, e.g., using databases without contacting patients directly. Though there are benefits to active pharmacovigilance, it is not without its potential risks. Here I highlight one of those risks – the nocebo effect. Nocebo effects are harms that are (...) thought to arise by conditioning or negative expectation. If a patient engaged in active pharmacovigilance is improperly motivated to seek out and report suspected adverse drug reactions, nocebo harms can occur. Not only is this a bioethical concern about harm, but it is also an epistemic or data-quality problem. Since nocebo effects are not due to the pharmacological properties of the drugs under investigation, nocebo effects reported as suspected adverse drug reactions constitute false positives in these databases. The underreporting of suspected adverse drug reactions hinders pharmacovigilance. Solutions to underreporting are oftentimes directed at clinicians and health care professionals. However, given the recent rise of public inclusion in medical science, solutions may soon begin more actively involving patients. I aim to offer an evaluative framework for future possible proposals that would engage patients with the aim of mitigating underreporting. The framework may also have value in evaluating current reporting practices. The offered framework is composed of three criteria that (...) are bioethical, social-epistemic, and pragmatic: (i) patients should not be exposed to undue harms, e.g., nocebo effects; (ii) data should be collected, analyzed, and communicated prioritizing pharmacovigilance’s aims, i.e., free from industry bias; and (iii) proposals should account for existing and foreseeable pragmatic constraints like clinician ‘buy in’ and existing reporting infrastructure. Proposals to engage patients in pharmacovigilance that fulfil or address these criteria are preferable to those that do not. (shrink)

The Oxford or Tractarian Movement and later Ritualists and Anglo-Catholics schooled numerous converts in elements of the Catholic faith. Foremost among them was John Henry Cardinal Newman, one of the original founders of the Oxford Movement. Converts numbered in the hundreds and included another cardinal, Henry Edward Manning, the second Archbishop of Westminster, the religious foundress Cornelia Connelly, the priest novelist Robert Hugh Benson and later literary figures such as G.K. Chesterton, Evelyn Waugh and Mgr Ronald Knox. American historian, Patrick (...) Allitt, has argued that on both sides of the Atlantic converts dominated Catholic intellectual life between 1840 and 1960. While such 'Tractarian' converts have indeed greatly influenced Catholic life, many 'Tractarians' who never converted have also had a considerable impact on English-speaking Catholicism. C.S. Lewis is an obvious example. But there have been others, including author Charles Williams, poet T.S. Eliot and theologians John Macquarrie and Michael Ramsey. The author Dorothy L. Sayers also deserves to be counted among their number. (shrink)

The object of this paper is to review and examine some of the things which G. E. Moore says about the nature of intrinsic value, about the sort of objects which possess it, and about the method of ascertaining the intrinsic values of things. Most of the discussion will be based on Principia Ethica: for in that work Moore stated the substance of his ethical theories once and for all. He explicitly changed his mind later on a few specific issues, (...) which will be noted when they are relevant: and I shall argue in my fourth section that he also changed his mind in one matter without acknowledging that he was doing so. With those exceptions, it seems to me that his later writings differ from Principia chiefly by their style of presentation and by the introduction of some new distinctions, and I shall think myself justified, on most points, in treating them as an aid to amplifying or refining the position which Moore adopted in Principia. The other works to be referred to are Ethics; “The conception of intrinsic value”, written about 40 years ago and published in Philosophical Studies; “Is goodness a quality?” in Arist. Soc. Sup. When John Langshaw Austin died in ???? he had published only seven papers, together with a translation into English of Frege.

A collection of eight essays, this book is not intended as a comprehensive anthology like K. T. Fann’s Symposium on Austin. G. J. Warnock’s foreword indicates an attempt to rectify the apparent misunderstandings of Austin and his intentions. With the exception of the essays by D. F. Pears and John R. Searle, all are written especially for the volume. Three of the works, those by Sir Isaiah Berlin, George Pitcher, and G. J. Warnock, present an informative account of (...) Austin’s activities at Oxford. Professor Berlin’s "Austin and the Early Beginning of Oxford Philosophy" offers a valuable personal account of Austin’s early years as "a very clear, acute, and original intellect." In the "Thursday meetings", Austin’s main purpose seemed to Berlin "then, and afterwards, to be the establishing of particular truths with a view to generalizing from them, or eliciting principles at a later stage." Pitcher’s "Austin: A Personal Memoir" gives an account of Austin’s stay and influence at Harvard in 1955. Warnock’s "Saturday Mornings" recollects Austin’s activities in the 1950’s. (shrink)
